ONLINE PRIVACY POLICY
Please DontGo, LLC dba DontGo and DontGo.com has created this online privacy policy in order to demonstrate our firm commitment to privacy. Please DontGo, LLC is an online provider of chat box and instant messaging services to retail clients on the Internet. When you visit the website of our client (the “Client”), including the original Client website you visited for products, services or information (hereinafter the “Client Website” or “Client’s Website”), we launch a chat box or instant messaging service that permits you to communicate with us and our Client through our chat and messaging services (the “Chat Box”). The following discloses the information gathering and dissemination practices for Please DontGo, LLC’s online Chat Box and related online/website services in supporting our Clients and their interactions with people like you who visit a Client Website.
1. Introduction.
(a) Web Site Owner. Please DontGo, LLC (hereinafter “DontGo”, “we”, “our”, or “us”) is the owner of the DontGo website whose URL is www.dontgo.com (“DontGo Website”). However, our Client is the owner of the Client Website, not DontGo. For information about our Client and/or our Client’s Website, you should go to the Client Website directly to review our Client’s own privacy policy and/or to contact our Client at its published phone number, address or email address for the public. If you desire to contact DontGo, the owner of the DontGo Website, we can be contacted by mail at 977 E. 14 Mile Rd., Troy, MI 48083, by phone at 800-922-5555, or by e-mail at awebb@dontgo.com. This online privacy policy notice discloses DontGo’s information practices for the DontGo Website and also our online Chat Box, including what type of personal identifiable information is requested in order to make a purchase inquiry or to request services from a Client, how the information is used, and with whom the information is shared. Please note that a Client’s Website will be governed by the Client’s own, separate privacy policy practices and notices applicable to the Client and the Client’s Website.
(b) Anonymous Web Site Visits. In general, you can visit on the DontGo Website without disclosing or revealing any personal information. DontGo may, however, keep track of the domains from which people visit us as well as third-party audience data (such as age, gender, location, and interests) collected through Google Analytics. Further, DontGo may analyze the data gathered from our DontGo Website visits for trends and statistics. Further, you can access and use our Chat Box without disclosing or revealing any personal information. However, if you access our Chat Box from Client’s Website, we will permit you to provide us with personal identifiable information for the purpose of communicating with our Client for services or products that you may desire to evaluate or obtain from our Client.
(c) Website and Chat Box Transactions. At times, DontGo will need personal information regarding a client, customer or a prospect. For example, to process an order or provide service subscription information, DontGo may need to know your name, mailing address, e-mail address and telephone number. Similarly, if you access a Client Website and utilize our Chat Box to inquire about a Client’s products or services, DontGo will need to know your name, mailing address, e-mail address and telephone number. It is our intent to inform you before we collect personal information from you on the Internet.
2. Personal Information that May Be Collected.
(a) Identifying Information. In order to inquire about purchasing DontGo’s Internet products and/or services so that you can become a Client of DontGo, or in order for you to inquire about one of our Client’s products or services when visiting our Client’s Website and accessing our Chat Box, we will request you to provide certain personal identifying information to us, which may include: your name, postal address, email address, and telephone number.
(b) Information from Children. DontGo does not knowingly sell products or services for purchase by children and will not knowingly collect or post information from a child under the age of 18.
(c) Client Websites. Even though a DontGo Chat Box is accessible from a Client’s Website, DontGo is not responsible for the privacy practices or the content the Client’s Website.
3. Uses Made of the Information.
(a) Limited Uses Identified. Without your prior consent, DontGo will not use your personal identifiable information for any purpose other than that for which it is submitted. However, DontGo transmits your personal identifiable information to the Client whose Client Website you originally accessed, so that the Client can communicate with you directly and reply to your inquiry for or about products or services of the Client. If you did not originally visit a Client Website and instead directly visited our DontGo Website, in order to inquire about our products or services as a prospective client of DontGo, we will use your personal identifiable information only for purposes of communicating with you about becoming a client of ours and to furnish you with information about our DontGo products and services.
(b) Stored Information Uses. DontGo is in the business of providing Chat Box services to our Clients, so that our Clients can acquire new customers, clients and/or users for their own products or services. Thus, DontGo stores and retains the personal identifiable information you enter or transmit through our Chat Box. This information is transmitted to our Client to enable our Client to recommend products or services that may be of interest to you. Further, stored information is used by DontGo and our Client to support customer interaction with the Client Website and to verify whether a Client acquired its customer, client or user through a DontGo Chat Box interaction.
(c) No Sale of Information to Others. DontGo will not sell your personal information to marketing firms, advertisers or third parties. However, as set forth in this privacy policy, if you provided DontGo with personal information through a Chat Box generated on a Client’s Website, DontGo will transmit your information to the Client whose website you originally accessed.
4. Disclosure of the Information
(a) Within Corporate Organization. DontGo is a business organization with many departments and personnel. DontGo may share your personal information within the DontGo corporate organization.
(b) Mergers and Acquisitions. Circumstances may arise where for business reasons, DontGo decides to sell, buy, merge or otherwise reorganize its businesses in the United States or some other country. Such a transaction may involve the disclosure of personal identifying information to prospective or actual purchasers, and/or receiving such information from sellers. It is DontGo’s practice to seek appropriate protection for information in these types of transactions.
(c) Agents. DontGo may employ or engage other companies and individuals to perform business functions on behalf of DontGo. These businesses and persons may be provided or have access to personal identifying information required to perform their functions, but DontGo will seek appropriate protection for information in these types of transactions. These businesses and persons may be engaging in a variety of functions which include, but are not limited to, storing data, hosting servers, and analyzing data.
(d) Client Businesses. DontGo works closely with its Clients to improve their websites and interaction and communication with prospective customers, clients, visitors and users. Thus, all information provided through a Chat Box accessed or generated from a Client’s Website is transmitted to, and shared with, our Client.
(e) Marketing Analysis by Third Parties. DontGo reserves the right to disclose to third parties any identifiable information about customers for marketing and customer acquisition analysis; however, any information disclosed will be in the form of aggregate data that does not describe or identify an individual customer.
(f) Disclosure to Governmental Authorities. Under certain circumstances, personal information may be subject to disclosure pursuant to a judicial order or other government subpoenas, warrants or orders.
5. Use of Computer Tracking Technologies.
(a) No Tracking of Personal Information. DontGo’s Website and Chat Box are not set up to track, collect or distribute personal information not entered by visitors. However, through website access logs, DontGo reserves the right to collect clickstream data and HTTP protocol elements, which generate certain kinds of non-identifying site usage data, such as the number of hits and visits to our website and/or Chat Boxes. This information is used for internal purposes by technical support staff for research and development, user analysis and business decision making, all of which provides better services to the public. The statistics garnered, which contain no personal information and cannot be used to gather such information, may also be provided to third parties.
(b) Use of Cookies. DontGo, or its third party vendors, may collect non-identifiable and personal information through the use of various technologies, including “cookies”. A cookie is an alphanumeric identifier that a website can transfer to customer’s or visitor’s hard drive through the customer’s or visitor’s browser. The cookie is then stored on customer’s or visitor’s computer as an anonymous tag that identifies the customer’s or visitor’s computer, but not the customer or visitor. Cookies may be sent by DontGo or its third party vendors. Customers and visitors can set their browser to notify them before a cookie is received, giving an opportunity to decide whether to accept the cookie. Customers and visitors may also set their browser to turn off cookies; however, some websites or Chat Boxes may not then work properly.
(c) Use of Google Analytics and Advertising Features. Google Analytics is a web analysis service provided by Google. Google utilizes the data collected to track and examine the use of DontGo’s website, to prepare reports on its activities, and share them with other Google services. Google may use the data collected to contextualize and personalize the ads of its own advertising network. Further, DontGo may implement certain tracking features supported by Google Analytics for Display Advertising Demographics and Interest Reporting. The data collected (age and gender) is used to better understand our visitors and help us provide the most relevant content we can. DontGo may also employ Remarketing with Google Analytics to advertise online. Third-party vendors, including Google, may show our ads on sites across the Internet. DontGo and third-party vendors, including Google, use first-party cookies (such as the Google Analytics cookie) and third-party cookies (such as the DoubleClick cookie) together to inform, optimize, and serve ads based on someone’s past visits to our website. You can opt out of Google Analytics for Display Advertising and/or customize Google Display Network ads using the Google Ads Settings or Google Analytics opt-out browser add-on. We will not facilitate the merging of personally-identifiable information with non-personally identifiable information previously collected from Display Advertising features that is based on the DoubleClick cookie unless you have provided DontGo with prior affirmative (i.e., opt-in) consent to such merger.
(d) Use of Web Beacon Technologies. DontGo may also use web beacon or other technologies to better tailor the DontGo Website or Chat Box to provide better customer service. If these technologies are in use, when a visitor accesses these pages of the website or Chat Box, a non-identifiable notice of that visit is generated which may be processed by DontGo or by its suppliers. Web beacons usually work in conjunction with cookies. If customers or visitors do not want cookie information to be associated with their visits to these pages or Chat Boxes, they can set their browser to turn off cookies; however, Web beacon and other technologies will still detect visits to these pages or Chat boxes, but the notices they generate cannot be associated with other non-identifiable cookie information and are disregarded.
(e) Collection of Non-Identifiable Information. DontGo may collect non-identifiable information from user visits to the DontGo Website or to a Chat Box generated from a visit to a Client’s Website in order to provide better customer service. Examples of such collecting include: traffic analysis, such as tracking of the domains from which users visit, or tracking numbers of visitors; measuring visitor activity on the DontGo Website or on Chat Boxes for Clients; website and system administration; user analysis; and business decision making. Such information is sometimes known as “clickstream data.” DontGo and/or its contractors and Clients may use this data to analyze trends and statistics.
(f) Collection of Personal Information. DontGo collects personal identifying information from customer or visitor during a transaction. DontGo may extract some personally identifying information about that transaction in a non-identifiable format and combine it with other non-identifiable information, such as clickstream data. This information is used and analyzed only at an aggregate level (not at an individual level) to help DontGo and its Clients understand trends and patterns. This information is not reviewed at an individual level.
6. Information Security.
(a) Commitment to Online Security. DontGo employs physical, electronic and managerial procedures to safeguard the security and integrity of personal information. If DontGo were to ever collect billing and payment data from a customer or visitor, such data would be encrypted whenever transmitted or received online. Personal information is accessible only by staff designated to handle online requests or complaints. All of our Clients, agents and contractors with access to personal information on the DontGo Website or Chat Boxes are also bound to adhere to DontGo security standards.
(b) No Liability for Acts of Third Parties. DontGo will exercise all reasonable efforts to safeguard the confidentiality of customer or visitor personal information. However, transmissions protected by industry standard security technology and implemented by human beings cannot be made absolutely secure. Consequently, DontGo shall not be liable for unauthorized disclosure of personal information due to no fault of DontGo including, but not limited to, errors in transmission, third party hacking, security breaches by third parties, and unauthorized acts of DontGo staff and/or third parties.
7. Privacy Policy Changes and Opt-Out Rights.
(a) Changes to Privacy Policy. This privacy policy notice was last updated on August 1, 2017. DontGo reserves the right to change or update its privacy policy at any time. A notice of any material change will be posted on the DontGo Website or, if applicable, the DontGo Chat Box link for at least thirty (30) days. Your use of the DontGo Website or Chat Box is deemed your acceptance of (and consent to) this privacy policy and all of our stated privacy policy practices. Further, your continued use of our DontGo Website or Chat box shall be deemed your express acceptance of all changes to our privacy policy.
(b) Opt-Out Right. A customer, visitor and/or prospective customer has the right at any time to cease permitting personal information to be collected, used or disclosed by DontGo and/or by any third parties with whom DontGo has shared and/or transferred such personal information. Right of cancellation may be exercised by contacting DontGo via e-mail (at privacy@dontgo.com) or certified postal mail. After processing the cancellation, DontGo will delete the requesting customer, visitor or prospective customer’s personal information from its data base.
(c) California Residents – Your California Privacy Rights.
(1) Requesting Information. Under California law, DontGo’s customers or visitors who are California residents may request certain information regarding our disclosure of personal information to third parties for their direct marketing purposes. As detailed above, we do not share our customer’s or visitor’s personal information with unaffiliated third parties for advertising purposes.
(2) California Opt-Out Rights. If at any time you wish to opt out of having your personal information shared with third parties and/or receiving information from DontGo, you can do so. You may contact us at DontGo Privacy Policy, Attn: Opt-Out Administrator, 977 E. 14 Mile Rd., Troy, MI 48083. You can also contact us by e-mailing us at privacy@dontgo.com. Please indicate what products, services and/or promotional information you no longer wish to receive from DontGo.
8. No Access Rights to Data.
(a) Information Maintained from Chat Boxes. Since DontGo transmits to its Client all personal information obtained through a Chat Box servicing a Client’s Website, any requests from a customer, client, visitor or prospective customer of a Client for details of his/her personal information maintained in the Client’s data base must be directed to the Client and not to DontGo.
9. Accountability.
(a) Questions, Problems and Complaints. If you have a question about this privacy policy statement, or a complaint about DontGo’s compliance with this privacy policy, you may contact DontGo by e-mail (at privacy@dontgo.com). If DontGo is unable to resolve your complaint to your reasonable satisfaction or if you do not receive acknowledgment of an inquiry, you may elect to proceed by contacting DontGo’s legal department in writing at 977 E. 14 Mile Rd., Troy, MI 48083.
(b) Terms of Use. If you choose to access DontGo’s website or use its Chat Box generated from a Client’s Website, your action is hereby deemed acceptance of DontGo’s privacy practices described in this privacy policy statement. Any dispute over privacy between you and DontGo is subject to the provisions of this privacy policy notice.
